Banking News – The Nepal Bar Association has stated that it will firmly face any attempt to run the judiciary in one’s favor through pressure, influence, or any other means. The Bar has made public this stance while expressing objection to the incident of the government taking former Chief Justice Cholen Dra Shamsher Jabara into security custody at midnight. In a press release issued on Monday by Bar General Secretary and Senior Advocate Kedar Prasad Koirala, it is stated that serious attention has been drawn to the incident of Jabara being taken into custody at midnight on Ashoj 10, 2083, citing security threats.

The Bar has stated that taking any citizen into custody and releasing them without sufficient basis and reason is contrary to the constitution, rule of law, and democratic governance system.

The Bar states that the matter of not allowing representatives of the National Human Rights Commission to meet with Jabara has further increased the seriousness of the incident. The statement describes this as a sign that the government is sliding toward authoritarianism and illiberalism. The Nepal Bar Association has stated that it has been continuously raising its voice in favor of judicial good governance against anomalies, irregularities, and corruption in the judiciary. Stating that the judiciary must be clean and corruption-free, the Bar has stated that it will oppose any kind of interference against the cleanliness and independence of the judiciary by the government, political leaders, or former officials of the judiciary.

Similarly, the Bar has also opposed recent unconstitutional incidents against freedom of thought and expression. It has drawn the attention of relevant agencies not to arrest any citizen unnecessarily without basis, reason, and evidence.

“The Nepal Bar Association will firmly face any attempt to run the judiciary in one’s favor by applying pressure, influence, and impact,” the statement says. The Bar has also urged all concerned not to engage in any kind of interference, interest, concern, or discussion in pending cases by retired chief justices, judges, or any other person. Similarly, it has again requested the Chief Justice to immediately implement the arrangement of forming the constitutional bench on the basis of seniority or by lottery. The Bar has stated that it will remain with support and cooperation in every step taken for the cleanliness and purity of the judiciary.
